Can the IRS see my bank account?

Short answer

The IRS sees what your bank reports about your account. That means interest of $10 or more on Form 1099-INT and, for some nonresidents, deposit interest on Form 1042-S. In an audit or to collect unpaid tax, the IRS can also contact your bank, and it can levy the account after sending notices.

When the IRS contacts your bank

When the IRS examines a return or collects tax, it can contact third parties such as your bank. Publication 556 says the IRS must give you reasonable notice in advance that it may do so. There are exceptions, such as a pending criminal investigation or when notice would put collection of the tax at risk.

How a bank levy works

A levy is a legal seizure of property to pay a tax debt, and a bank account can be levied. The IRS usually does it only after these steps:

  1. 1

    A tax bill

The IRS assesses the tax and sends you a Notice and Demand for Payment.

  2. 2

    No payment

You neglect or refuse to pay it.

  3. 3

    A final notice

The IRS sends a Final Notice of Intent to Levy and Notice of Your Right to a Hearing at least 30 days before the levy, plus advance notice that it may contact third parties.

  4. 4

    The levy reaches the bank

The money in the account is frozen when the bank receives the levy. The bank then waits 21 days before sending it, so you can contact the IRS to pay or point out errors. Money you add after the levy normally isn't affected.
